Sellers with EU Operations Must Update Information to Meet Tax Reporting Requirements

In a significant update that affects numerous online sellers, Amazon UK has issued a directive to Sellers on Seller Central regarding compliance with the European Union's Directive on Administrative Cooperation (DAC7). This directive mandates enhanced reporting obligations for digital platforms, aiming to ensure tax transparency across the EU.


Who is Affected, and What Information is Required?
DAC7, a key component of the EU's tax regulation framework, requires digital platforms like Amazon to report certain information about sellers to tax authorities annually. This includes revenue, business, and personal information for sellers whose primary address is in the EU, generating €2,000 or more in sales or completing 30 or more transactions within a calendar year.

Action Required from Sellers
Sellers meeting these criteria must take several steps to comply with DAC7:
1. Update Information: Sellers must confirm and update their Tax Identification Number, Company Registration Number, and details about permanent establishments for all active stores on Amazon. Since the EU is treated as a single entity in this context, updating this information once suffices for all EU countries.
2. Use of DAC7 Portal: Required information must be added to the Legislation Compliance DAC7 portal on Amazon.
3. Regular Review and Declaration: Sellers must review their information and declare its accuracy every 36 months. Any changes to business information, such as address updates, necessitate a new review and declaration.

Consequences of Non-Compliance
Failure to provide the required information within 60 days of receiving the initial notification from Amazon can lead to severe consequences. Amazon has stated that it will deactivate seller accounts and withhold funds until compliance is achieved. This measure underscores the importance of timely and accurate information submission to avoid disruptions in service and financial penalties.
